elevenM has launched the Victorian Privacy Case Note Database, a free repository of detailed case notes on all determinations made under the Victorian Privacy and Data Protection Act 2014 (PDP Act) and Information Privacy Principles (IPP).
The Victorian Privacy Case Note Database is a micro-site (open access, no subscription or paywall) that contains case notes on prominent Victorian Civil and Administrative Tribunal (VCAT) and Victorian Supreme Court (VSC) decisions on the IPPs and PDP Act, as well as the predecessor to the PDP Act (the Information Privacy Act). Each case note contains a summary of the decision as well as our commentary. The commentary provides insights like has a particular interpretation been followed or rejected by subsequent cases; how does it stand with the Office of the Victorian Information Commissioner (OVIC) and the Office of the Australian Information Commissioner’s (OAIC) guidance; and sometimes our own thoughts when we think an interpretation is unique or curious.
Each case note is also tagged — you can search by the relevant IPP or by a relevant term that might cross multiple principles. For example, you can search for ‘IPP 2.1 – Use or disclosure’ or ‘personal information’ or ‘remedies’.
We hope people working in Victorian privacy law will find it useful to have access to a resource that has all the prominent decisions in one place, is searchable, gives information and analysis about the usefulness of that decision/interpretation.
Use this resource to:
- Resolve privacy complaints – check how a court or tribunal has previously considered similar circumstances to a complaint you are handling and get a better understanding of how it was resolved.
- Make better decisions about proposed disclosures – find out what a court or tribunal has said (as well as our commentary) about IPP 2.1 and exemptions to it.
- Gain better clarity on your obligations when implementing a privacy program – research into issues like what courts and tribunals consider ‘reasonable steps’ when it comes to data accuracy or security.
